Le BijouBijou offers the website, including all information, tools, and services available from the website, to you, the user, conditioned upon your acceptance of all the terms and conditions stated here as well as the Privacy policy and notices stated on this website. This agreement will apply to any new features or tools we add to the website. From time to time, we will update, change, or replace any part of this agreement. Please check this page periodically for changes. Your use of the site constitutes your agreement to these conditions.
PRODUCTS & SERVICES
Le BijouBijou attempts to be as accurate and complete as possible. However, Le BijouBijou does not warrant that product description or other content on the Lebijoubijou.com website is accurate, complete, reliable, current, or error-free. We do our best to display as accurately as possible, the colors and images of our products. We cannot guarantee that your screen’s display of any color will be accurate. If a product offered by Le BijouBijou is not as described, you may return it in an unused condition and on your expenses. Our Return Policy applies to any products you buy through our website. Any offer for any product or service made on this site is void where prohibited. We reserve the right to refuse any order you place with us. We may limit or cancel quantities purchased per person, per household, or order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. If we make a change to or cancel an order, we may attempt to notify you by contacting you at the e-mail address, billing address, or phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.
PRICES
Prices and availability of items are subject to change without notice. Le BijouBijou makes every attempt to ensure all products, descriptions, and pricing listed on our website are accurate. In the unlikely event an error occurs, Le BijouBijou will not be bound to this error. We cannot guarantee that all information posted on our website is current, accurate or complete. Le BijouBijou will correct any known issues as soon as possible and allow you to complete your order or cancel it. In the event a product or service is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information, Le BijouBijou retains the right to refuse or cancel any orders placed for products or services listed at the incorrect price. We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, we will immediately issue a credit to your credit card account in the amount of the charge.
BILLING, PAYMENT & DELIVERY INFORMATION
Orders are a sale agreement which will be concluded with written confirmation of the order sent to you. The delivery of your BijouBijou will be to the indicated address given at the time of ordering. Shipping costs and time may vary. You will make payment at the time of placing the order either by credit card or as specified in the applicable section of this website.
PRODUCT SAFETY
Not suitable for children under 3 years. Bracelets may break when not adequately handled, and small parts can be swallowed.
LIABILITY DISCLAIMER
Liability claims against Le BijouBijou and/or Big Picture Production GmbH based on damages of a physical or immaterial nature, which arise from access to, or use or non-use of the published information through misuses of the connection or technical faults, are excluded.
(Not Applicable to Quebec consumers) To the fullest extent allowed by law, our responsibility for defective products is limited to repair, replacement or refund as described in these Terms & Conditions, and our liability will under no circumstances exceed the actual amount paid by you for the defective product that you have purchased through the Le BijouBijou Website or any third party shop, nor will we under any circumstances be liable to you or any third party for any consequential, incidental, special or punitive damages or losses, whether direct or indirect.
For the avoidance of doubt, the foregoing shall not preclude your recovery of damages for personal injury, loss or damage to personal property, or unauthorized use or disclosure of personally identifiable information caused by our negligence, gross negligence, recklessness, fraud or other willful, unconscionable or intentional misconduct. Nothing herein shall be construed to limit the clearly established legal right of a consumer to recover attorneys’ fees or other remedies afforded by statute or other law.
CHANGES TO THESE TERMS AND CONDITIONS
Le BijouBijou has the right to change, modify, add or remove any portion of these Terms and Conditions at any time by posting revised terms on the website. It is your responsibility to check them periodically for changes. Revised Terms and Conditions will take effect five days after their publication on the website. You agree to these changes by using our website after that.
APPLICABLE LAW / JURISDICTION
Swiss law applies exclusively to the exclusion of the conflict of laws norms of the Vienna sales law. The place of jurisdiction is the ordinary courts at the seat of the seller.
